The law on counteracting fictitious registration of foreigners was approved by the State Duma

 Today at the plenary meeting on Thursday, September 27, the State Duma approved in the third reading amendments to the Law “On migration registration of foreign nationals and stateless persons”. The act specifies the meaning of ”fictitious registration at the place of temporary residence“.

According to the amendments approved by the parliamentarians, ”fictitious registration at the place of temporary residence“ is the registration of a foreign national or stateless person at the place of temporary residence based on providing knowingly false information or documents, or registration at the place of temporary residence in a residential or alternative premise without their intention to do actually live there“.

Under current legislation such restrictions are already applied only to residential premises, but not to non-residential ones.

The act proposes to understand fictitious registration when ”a foreign national or stateless person are registered at the place of temporary residence at the address of the organization in which they do not work or are not engaged in other activities not prohibited by the legislation of the Russian Federation”.

”The bill, first of all, is aimed at protection of the interests and security of Russian citizens, as well as those citizens of foreign states who arrived in our country legally and with legitimate interests. We must close the loophole for fictitious registration, it means to prevent the threat of persons staying on the Russian territory for performing extremist and terrorist activities. In addition, our goal is to prevent the creation of fictitious office cities of illegal migrants, such as the ‘personnel center ‘East’, where 3,3 thousand migrants are registered in the territory of 34 square meters and the Interregional Trade Union ‘Protection’ — 56 thousand migrants’, — Deputy Chairwoman of the State Duma Irina Iarovaia explained.

”In addition, by determining responsibility for the maintenance of so-called ‘unlimited offices’, we allow law enforcement officers to prevent socially dangerous actions and protect the interests of Russian citizens. Automatically it obliges the law enforcement officers to exercise proper control, and therefore leads to responsibility of the law enforcement officers in case of its improper exercise“, — the author of the bill added.

”These issues are extremely relevant for Russian regions. Therefore, [draft laws] had been developing within regional security and migration policy approach“, — Irina Iarovaia said.

Deputy Chairwoman of the State Duma added that the draft law was developed following the meeting of the members of the Lawmakers Council with the President of the Russian Federation Vladimir Putin held on April 24, 2017, and it received positive reference from the Government of the Russian Federation and the Supreme Court and was backed by the United Russia faction.
